Terms and Definition

Terms and definition given under this section is based on the Digital Personal Data Protection Act, 2023.

“Board” means the Data Protection Board of India established by the Central Government under section 18.

“Consent Manager” means a person registered with the Board, who acts as a single point of contact to enable a Data Principal to give, manage, review, and withdraw her consent through an accessible, transparent, and interoperable platform.

“Personal Data” mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, can identify such a person.

“Data Fiduciary” means any organization who alone or in conjunction with other organization determines the purpose and means of processing of personal data.

“Data Principal / PII Principal / Data Subject” means the individual to whom the personal data relates and where such individual is—

• a child, includes the parents or lawful guardian of such a child.
• a person with disability, includes her lawful guardian, acting on her behalf.

“Data Processor” means any organization who processes personal data on behalf of a Data Fiduciary.

“Data Protection Officer” means an individual appointed by the Significant Data Fiduciary under clause (a) of sub-section (2) of section 10.

Who is your Data Fiduciary?

Your personal data is collected and processed by Renault Nissan Technology Business Center India Private limited (RNTBCI), as Data Fiduciary and shared with Renault SAS (Parent company group) acting as a joint controller.

Types of Personal Data Collected

While using the Application, we may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Data Retention & Deletion

We undertake to keep your personal information for no longer than is necessary for the purposes for which we process them, in accordance with the regulation.

In order to calculate the retention period of your personal data, we use notably the following criteria:

• The time required to proceed your request or your claim,
• The duration for which your user account is opened, unless you have been inactive for 3 years, Our legal or regulatory obligations

We may have to keep some of your personal data for a longer duration, in an archive file, in order for us to be able to defend in a legal action, until the end of the statute of limitation provided by applicable law.

RNTBCI is Information Security Management Systems ISO 27001 certified organization. We apply appropriate technical, organizational, and administrative security measures in line with ISO 27001 requirements to protect any Personal Information we store from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

Cross-Border Data Transfer

Your Personal Data may be transferred to and stored in countries other than your own, which may have different data protection laws. We ensure that such transfers are conducted in compliance with applicable data protection regulations and take measures to safeguard your data by implementing appropriate protections and agreements with third parties involved in processing your data.

User Rights and Contact information

The Data Principal shall have the following rights to exercise in respect of processing of the personal data.

Right to access information about personal data

The Data Principal has the right to obtain confirmation on the processing of data, summary of the personal data being processed & identities of all Data Fiduciaries and Data Processors processing the data.

Right to correction & erasure

The Data Principal shall have the right to correction & erasure of personal information which includes correction, completion or updating of personal data.

Right to Grievance Redressal

The Data Principal shall have the right to register a grievance with Data Fiduciary or Consent Manager in respect of any act or omission of such Data Fiduciary or Consent Manager regarding the performance of its obligations in relation to the personal data of such Data Principal or the exercise of her rights under the provisions of this Act and the rules made thereunder.

Right to nominate

In the event of death or incapacity, a Data Principal shall have the right to nominate any other individual to exercise the rights of data principal.

Changes to this Notice

We may change this notice from time to time. We will inform you and/or seek your consent whenever necessary or required. We, therefore, recommend that you consult this notice each time you visit our website to review the latest version.
